Terms of use
These terms are an agreement between you and OjaCocoa Limited (RC 9847615), which runs OjaCocoa. By creating an account or using the app you agree to them. If you do not agree, do not use OjaCocoa.
1. What OjaCocoa is
OjaCocoa is a marketplace app that helps cocoa farmers and buyers in Nigeria find each other, exchange offers and talk. We are not a buyer, seller, agent or broker, and we are not a party to any deal you make.
We do not handle payments, weigh or grade cocoa, transport it, or guarantee its quality, quantity, or that anyone will pay or deliver. Those are agreed between you and the other person.
2. Who can use it
- You must be at least 18 years old and able to enter into a contract.
- You may have one account, in your own name, with a phone number you control.
- The information you give us must be accurate, and you must keep it up to date.
- You are responsible for what happens under your account. Keep your password private.
3. If you sell
- List only cocoa you have or can supply, in the quantity you state.
- Describe the grade honestly, and use photos of the actual beans you are selling.
- Keep your listings current. Mark them sold or remove them when the cocoa is gone.
- If you accept an offer and cannot go ahead, tell the buyer straight away.
4. If you buy
- Make offers only when you intend to buy at that price and quantity.
- Pay what you agreed, on the terms you agreed.
- Inspect and weigh the cocoa before paying.
5. Offers and agreements
When a farmer accepts an offer in the app, the agreement is between the farmer and the buyer. The app records it and takes the accepted quantity off the listing. The final details, including price, weight, moisture, payment and collection, are for the two of you to agree and honour.
6. Prices shown in the app
Benchmark prices are estimates worked out from London cocoa futures and exchange rates. They are for guidance only. They are not an offer, a quote or a guaranteed price, and nobody is obliged to buy or sell at them.
7. Ratings and reviews
You can rate someone only after an offer between you has been accepted. Ratings must be honest and about that deal. Do not post fake, paid-for or retaliatory reviews. We may remove reviews that break these rules.
8. Contacting other users
Phone numbers are shared through the app one at a time, and there are daily limits on looking up numbers of people you have not dealt with. Use a number you receive only to discuss a cocoa trade. Do not copy, collect, publish, sell or pass on other users' numbers, and do not use them to send unwanted messages.
9. What is not allowed
- Fraud, including fake listings, fake offers or taking payment for cocoa you will not deliver.
- Pretending to be OjaCocoa staff, or asking anyone for a fee to "release" an offer, buyer or payment.
- Harassing, threatening or deceiving other users.
- Using scripts, bots or other automated tools to read or collect data from the app.
- Trying to get around limits, security rules or a suspension.
- Listing anything other than cocoa, or anything that is illegal to sell.
10. Suspending accounts
We may suspend or close an account that breaks these terms or puts other users at risk. Where it is safe to do so, we will tell you why. If you think we have made a mistake, contact us.
11. Your content
You own the listings, photos, messages and reviews you post. You allow us to store, display and deliver them as needed to run OjaCocoa. You must have the right to post anything you upload.
12. Availability
OjaCocoa is in a pilot. Features may change, and the service may sometimes be unavailable. We will try to give notice of significant changes.
13. Our responsibility
As far as the law allows, we are not responsible for losses arising from dealings between users, including disputes about quality, weight, price, payment or delivery. Nothing in these terms limits any responsibility that cannot be limited under Nigerian law.
14. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, and disputes will be decided by Nigerian courts.
15. Changes to these terms
If we change these terms we will update this page and the date at the top. If a change is significant we will tell you in the app. Using OjaCocoa after a change means you accept the new terms.
